Welcome to our website (“www.rugihome.com”). The access and the use of www.rugihome.com are regulated by these General Conditions of Use. These General Terms and Conditions (the “Terms and Conditions”) regulate access and use of the Site, and regulate the offer, sending and acceptance of purchase orders relating to products between users of the Site and Biseta Spa.

1.2 You will find information about orders and shipments, refunds and returns of purchased products on www.rugihome.com and the registration form on the website. The Provider (Us) may modify or simply update, in whole or in part, these General Conditions of Use. Changes and updates to the General Conditions of Use will be notified to users on the Home page of the website as soon as they are adopted and will be obligatory as soon as they are published on the website in this section. We therefore ask you to regularly access this section to verify the publication of the most recent and updated General Conditions of Use. By accessing or using the website, you agree to be legally bound by the following terms and conditions. If you do not agree, in whole or in part, with the General Conditions of Use, please do not use our website. 1.3 Products are displayed in the online shop in the most realistic possible way. The images are provided for general information only and may slightly differ from the actual product in terms of color. The products in our collections can be purchased while stocks last and RugiHome reserves the right to update the online catalog at any time, changing the number of products available.

2. General Terms of Sales Conditions

2.1 For the purposes of these General Sales Conditions, the following expressions shall have the meaning indicated below:
for ” General Sales Conditions ” it is intended the present general conditions that regulate the Products sale by Rugi Home on the website;
for ” Customer ” it is intended the subject that concludes a Contract with Rugi Home according to the General Sales Conditions;
for ” Contract ” it is intended the sale contract of the Products concluded online on the website according to the General Sales Conditions;
for ” Order ” it is intended the purchase order sent online through the Website rugihome.com for the purchase of the Products;
for ” Products ” are intended the goods sold by Rugi Home in accordance with the General Sales Conditions;

for “Website” it is intended www.rugihome.com

3. Contract Conclusion

3.1 Before sending the Order, the Customer must carefully read the General Sales Conditions. By placing an Order, the Customer fully accepts the General Terms of Sales Conditions and the Order content. The receipt by the Seller of the Order constitutes the conclusion of the Contract. The Order reception by the Seller constitutes the contract conclusion.

3.2 Rugi Home reserves the right to update or modify these General Sales Conditions at any time, in consideration of any legislative changes and business strategies.

4. How to purchase products

4.1 The Customer can purchase the Products included in the electronic catalogue that can be viewed online on the Website, as described in the related information sheets. It is understood that the image accompanying the description of a Product may not be perfectly representative of its characteristics but may differ in colour shades, also due to the technical differences of the monitors from which the object is observed. Consequently, Rugi Home will not be responsible for any inadequacy of the graphical representations of the Products shown on the Site, if due to the above technical reasons, since these representations have only informative function.

4.2 The Customer who sends the Order will receive the related Order confirmation from Rugi Home by the e-mail info@rugihome.com. The e-mail contains all the data provided by the Customer who commits himself to verify its correctness and to promptly communicate any corrections, according to the methods described in the General Sales Conditions. The Contract is concluded when Rugi Home receives the Order, after checking the data accuracy of concerning the Order itself.

4.3 Rugi Home may not process the Orders that do not provide sufficient solvency guarantees or that are incomplete or incorrect, which means in the event of unavailability of the Products.

4.4 In the case of a rejection of an Order, Rugi Home guarantees a prompt notification to the Customer.

5. Orders and Shipping

5.1 Once you have identified the product you are interested in, you can insert it directly into the shopping cart by clicking on the Purchase button. If you have chosen a product, placed it in the shopping cart and you want to proceed with the purchase of other items, you can return to visit the collections and put other products in the shopping cart. From this page you can change the quantity of the selected products, remove some items and proceed with the purchase. If you are not sure about confirming the order once you have placed the products in the cart, simply clean the cart without saving, fill the cart is not binding at all. The cart will still be automatically cleared at the end of each session.

5.2 The Products will be delivered to the location specified in the Order by the Customer. If the Customer has provided incorrect information in the Order about the Products delivery destination, Rugi Home cannot be held responsible in any way for any consequence arising from the above-mentioned incorrect information provided in the Order by the Customer.

5.3 Shipments are made worldwide through TNT and DHL couriers. All services make deliveries between Monday and Friday from 9am till 6pm.

5.4 Shipping charges can vary depending on the size, weight and quantity of your purchases and depending on the destination, so the amount will be displayed at the checkout page, after entering the delivery address. Shipment costs are free of charge for deliveries made in Italy, except for the Islands, while they have to be paid in Europe and in the Extra CEE countries. Shipment only takes place after the payment has been received.

5.5 Shipping times may vary: for shipments to Italy, consider 2-3 working days, for shipments to Europe, 3-4 working days and for countries outside the EEC a maximum of 7 working days. Rugi Home does not assume any responsibility for delays due to customs clearance or payment transaction. Please note that you will have 30 days from the shipment of your order to contact us if you do not receive it. After this period, we cannot guarantee the refund. If for any reason the shipment is delayed beyond the estimated delivery time, you will be advised by email info@rugihome.com.

5.6 All our products travel properly packaged. We recommend to always check the number and the good packages condition, otherwise the complaint must be made immediately to the courier and promptly notify us of the happened. In this case the costs of replacement and return will be borne by Rugi Home.

5.7 Enter a reliable delivery address! Our courier delivers during the normal business hours (9.00-18.00), for this reason we recommend to choose an address where he will find someone to arrange the delivery. For that places away from towns, we recommend to indicate when ordering, a telephone number in order to facilitate the courier work.

5.8 Each shipment contains:

– The ordered product/s
– An eventual accompanying documentation required according to the expedition country;
– any informative and marketing material.

5.9 Import duty and tax may be applied by local customs authorities. It is a legal requirement that we declare the full transaction value of the contents of all packages. Local import duties and taxes are levied by the carrier on behalf of the local customs authorities. We don’t sell our products in these countries: Argentina, Brazil, Russia, South Korea, Thailand and Taiwan.

6. Payment Methods

At no time during the purchase procedure Rugi Home is able to know the information regarding the credit card (for example, the credit card number or its expiration date), transmitted via secure connection by encrypted protocol directly to the site of the person who manages the electronic payment (bank or Paypal). No computer archive of Rugi Home will store such data. Under no circumstances Rugi Home can be considered responsible for any fraudulent or improper use of credit and prepaid cards by third parts.

6.1 Credit and Prepaid cards
Rugi Home guarantees to its customers the maximum security of credit card as all transactions are processed by Unicredit Bank. It is intended that the Customer must be the holder of a valid credit card during the Products Order purchased online and the name on the credit card must be the same as shown on the billing data. In the absence of such conditions, it will not be possible to process the Order.

6.2 Bank Transfer
The bank transfer payment must be received within 3 days from the execution of the order with currency on the same day on which the transfer is made. Any delays must be communicated at the email address info@rugihome.com. In the absence of notifications by the customer, after three days the order will be considered invalid. The transfer causal must indicate the following data: Name and surname/Company name of the person who placed the Order, Order number, Order date.

As soon as the payment will be visible on the specified current account or the customer proves the bank transfer to Rugi Home, the latter will immediately proceed to shipment.

6.3 Cash on Delivery
The payment must be made in cash to the courier at the moment of the Products delivery. The service includes the Product payment increased by the price of 5.00 €. The Customer is required to check that the packaging results intact, undamaged, wet or otherwise altered. Any damage must be immediately notified to the courier who makes the delivery. Once signed the courier document, the customer can not oppose any claims about the external features of what is delivered.

Billing is not automatic, as the online store is meant for private customers, so if you need an invoice, please contact us at info@rugihome.com and send us the company’s tax details as soon as possible after purchase or within the same day.

7. Prices and Availability

7.1 The Products prices published on the website are expressed in euros and they include VAT. To the product price must be added the costs of any customs taxes (in the case of abroad shipments), which amount varies according to the delivery method required and according to the country of destination. The validity of the prices is always and only the one specified on the Website at the moment the Order is placed. The price and availability data shown on the website are subject to change without any notice.

8. Customer Responsabilities

8.1 It is strictly forbidden for the customer to enter incorrect and/or invented and/or fictitious data in the registration procedure necessary to activate the process for the execution of the General Sales Conditions and the related further communications; the personal data and the e-mail must exclusively be their real personal data and not of third parts and/or fictitious data.

8.2 Rugi Home reserves the right to prosecute any violation or abuse, in the interest and for the consumers protection.

9. Products Return

9.1 If for any reason you are not satisfied about the products received, you are entitled to replace the goods with another one of equal amount, or refund of the entire value, within 14 days of receipt of the goods, by making a request sending an email to info@rugihome.com.

9.2 The purchased product must be returned unused and in its original integral packaging and resaleable together with the purchase document. The returned and replaced goods travel at the cost of the customer and the replacement request will be accepted after the verification of the product and its packaging condition.

The effective time for crediting or returning the amounts you pay for the products purchase depends on the used payment methods:

– purchase by credit/debit card: the refund time depends on the credit/debit card company, but normally it takes place within two account statements. Remember that the value date of the credit is the same as the debit, so you will not suffer any loss in terms of bank interest.
– Delivery cash payment: the refund is made to the bank account provided by you, so the refund time depends on the accuracy of the data you enter, normally the crediting takes place within fourteen (14) days.

9.3 Rugi Home on its part, will replace the goods with another one of equal amount choosen by the customer, as long as it is available online, otherwise it will refund the entire product amount, except for the shipping cost.

9.4 Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

9.5 Rugi Home can retain the refund until it has received the Products or until the Customer has demonstrated that he has sent the Products, depending on which situation occurs first.

9.6 The shipment, until the receipt confirmation in the Rugi Home warehouse, is under the complete customer responsibility.

10. Third Parts Website Links

10.1 Links on the website allow to access at other websites. These linked sites are not under the Rugi Home control, which is not responsible for the contents on any linked site.

11. Jurisdiction and Competent Authority

11.1 Any dispute relating to the execution and/or interpretation and/or validity and/or resolution of the General Sales Conditions or the Contracts, is submitted to the Italian jurisdiction.

11.2 All disputes arising from these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the court of Milan, without prejudice to the consumer’s right to lodge a complaint with the court of his residence place.

12. Severance

If any provision of these Terms and Conditions shall be held invalid or inapplicable by any court or administrative body of competent jurisdiction, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect.

13. Intellectual property

Rugi Home does not authorize the reproduction or use for commercial or harmful purposes of any trademark, product name, design or any other material displayed on the Rugi Home website in which intellectual property rights exist. ALL RIGHTS RESERVED.
